Terms of Service

Oakspace.com reserves the right to change this Policy any time, so please, check this page at least once a month or when in doubt. Oakspace.com strives to provide the best possible service to all our customers, but we will not tolerate any unlawful activity or abuse on our servers. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you, other Oakspace.com customers and us against such harm.

Payment Terms/Policies/Refunds
Full payment is required before any hosting service is rendered, which includes renewals. Payment is through a valid credit card, PayPal or Interbank transfer. Prepayment is due at the time of ordering your Oakspace.com hosting plan, and then depending on the payment cycle intervals after that.

Oakspace.com offers a no risk Money Back Guarantee. If you are not satisfied with our service within 7 days, and wish to cancel, we will issue you a full refund of your purchase price excluding fees for Domain registration. We also offer pro-rata refunds for 12mth/annual payment term. For example, If you want to cancel 6mths down the track, we will pro-rata your refund.

If an account is cancelled by Oak Creations due to a violation of our Terms, there will be no refund issued. All monetary transactions are in Singapore dollars only. Oak Creations reserves the right to change prices at any time. This also applies to existing and new accounts. The Customer will be invoiced on a yearly or monthly basis depending on the Hosting Plan subscribed to. Accounts are considered to be defaulted if payment is not received with 14 days after date of invoice. Accounts whose amount exceeds 30 days payment are liable to have their Service interrupted or terminated. Such interruption or terminaton do not relieve the Customer of the obligation to pay all outstanding amounts. The Customer agrees to pay Oak Creations all its reasonable expenses, including attorney and collection agency fees, in enforcing its rights under these terms and conditions.

Domain Registration
1. Oak Creations will accept all new registrations and register them as soon as possible after payment has been processed and verified.

2. The domain name registration period runs for one year from the date of registration. After this time period has lapsed, registration renewal may be made upon receipt of payment of renewal fees.

3. Once a registration request has been completed, no refunds can be made by Oak Creations.

4. Until the registrant receives confirmation of registration from Oak Creations there is no guarantee that the domain name requested will be registered.

5. Oak Creations will do all they can to ensure that the registrant's details are submitted correctly during registration. As our system is automated the customer is advised to check that their details are correct before submitting the domain for registration.

6. The registrant agrees that all details submitted in respect of a domain name registration are true and correct. The registrant makes certain to Oak Creations that the registration of a domain name and the way in which it is used (directly or indirectly) does not infringe the legal rights of any third party. Oak Creations does not accept any responsibility for the use of registered domain names especially where there may be conflict over rights to ownership. The registrant indemnifies Oak Creations from any legal proceedings and costs that arise as a result of the registration of a domain name.

Blog Hosting
Hosting accounts can be terminated by Oak Creations if they are being misused by the user. Oak Creations reserves the right to suspend any blog hosting account.

The hosting of, reference to or linking to any of the following is not allowed.

1. Nudity, pornography, anything of a sexual, or of an obscene nature.
2. Violations of any copyright or any other right of any third party.
3. Threatening, abusive, harassing, defamatory statements.
4. Promotion of illegal activities (info on hacking, cracking, etc).
5. Hosting or linking to copyrighted files without permission
6. Information, instructions, or software containing about any kind of virus.
7. Hate speech or hate propaganda.
8. Content that links to content that violates Oak Creations Blog hosting TOS.
9. Scripts or systems that cause server performance to decrease or cause a serious problem with the smooth running of the server.
10. Misrepresentation of member's identity, or the impersonation of anyone.
11. Collection of personal information for illegal purposes.
12. Collection of personal information without users permission.
13. Content that is deemed by Oak Creations, in its sole discretion, to be harmful to Oak Creations, another company or organisation, or individual.
14. Solicitation or sale of any products or services that are harmful & illegal.

Oak Creations will not be responsible for any damages your business may suffer. Oak Creations makes no warranties of any kind, expressed or implied for services we provide. Oak Creations disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Oak Creations and its employees.

Bandwidth / High Resource Users
Oakspace.com allows for very generous traffic, and most sites never exceed 500MB per month, unless they offer shareware, sound, video, image and multimedia archives, are mirror sites or any site whose primary purpose is file distribution. Oakspace.com customers are discouraged from storing any files that cause excessive traffic on Dotable.com servers. Please contact Oakspace.com Technical Support team for more information. Again, 99% of the sites do not fall into this category and never reach our traffic limits.

We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law.

Any deliberate attempt to cause damage to Oakspace.com or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.

Any user which uses high resources, or high bandwidth which affects other customers and server performance, may have their account closed or the owner contacted to resolve the issue. Extra bandwidth can be bought in such situation. Oak Creations reserves the right to adjust the terms and conditions of service at any time.

Backups
Full backups are made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the customer's responsibility to maintain local copies of their web content any information.

The " Backup Manager " is included in each hosting plan and customer can use this tool to back up their files. If loss of data occurs due to an error of Oakspace.com, we will attempt to recover the data for no charge to the client. If data loss occurs due to negligence of customer in securing their account or by an action of the customoer, Oakspace.com will attempt to recover the data from the most recent archive for a SGD$50.00 fee.

Downgrade of Plan
There will be a SGD$20.00 one time admin fee for any downgrade of hosting plans.

Change of Particulars
It shall be the responsibility of the Customer to inform Oak Creations in writing of any change in Customer's personal particulars. If you have an enquiry please contact our support team.

Alterations to Terms and Conditions
Oak Creations reserves the right to adjust the terms and conditions of service at any time and these will typically be done by e-mail to customers, and edited online, but changes to the terms may not be broadcast. It is a good idea to check back every few weeks to see any changes and additions.
